TikTok Star Emilie Kiser's Son Drowned After 7 Minutes Unsupervised in Pool; Father Faces No Charges
A heartbreaking tragedy unfolded at the Arizona home of TikTok influencer Emilie Kiser. Her three-year-old son, Trigg Kiser, drowned in the family's backyard pool after being unsupervised for several minutes, according to a Chandler Police report. Despite initial police recommendations for charges, the boy's father will not face prosecution.
The Incident:
On May 12th, Trigg was playing in the backyard of the family's Chandler home. Security footage reviewed by investigators showed the toddler accidentally tripped and fell into the pool while playing with an inflatable chair. The police report states Trigg was left unsupervised in the backyard for over 9 minutes and was in the water for approximately 7 minutes before his father, Brady Kiser, discovered him floating and unconscious.
Discrepancy in Timeline:
Brady Kiser initially told authorities he lost sight of Trigg for "three to five minutes" while tending to the couple's newborn son, Theodore. However, the security video revealed the child was unsupervised for significantly longer – more than 9 minutes total, with 7 minutes spent in the pool. The police report noted, "Brady's statements do not match what is seen on the video; he did not accurately describe [the incident]
The family typically used a protective pool cover, but investigators learned it had been removed to "enjoy the pool" and not replaced at the time of the accident.
Tragic Outcome and Legal Decisions:
Trigg was rushed to the hospital but tragically died six days later, on May 18th.
Following an investigation, Chandler Police recommended on July 16th that Brady Kiser face a class 4 felony charge of child abuse. However, on July 25th, the Maricopa County Attorney's Office announced he would not face any criminal charges. They stated there was "no likelihood of conviction," calling the drowning a "tragic accident." Brady Kiser's attorney expressed gratitude for this conclusion.
Mother's Fight for Privacy:
Devastated by her son's death and the public attention, Emilie Kiser took legal action. On May 27th, she filed a lawsuit seeking to block public release of records related to Trigg's death, citing over 100 public records requests. The court granted temporary confidentiality on some filings.
After the decision not to charge Brady, Emilie's legal team specifically requested the removal of two pages from the Chandler Police report detailing Trigg's final moments. They argued these graphic details could be exploited to create "disturbing" AI-generated content. On August 8th, the Arizona Superior Court ruled in her favor, ordering the redaction of those two pages.
Emilie Kiser's attorney, Shannon Clark, stated the redactions protect "the dignity of a little boy whose memory should reflect the love and light he brought to the world," emphasizing they don't change the material facts of the accident. The family continues to grieve the profound loss of their son Trigg.
